A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.
Reasons
Punishment of the crime
1. The Defendant, in collusion with C and D, had a significant role in real transaction of the land provided as collateral in calculating the amount of loan available to the unit agricultural employees. The Defendant, in collusion with C and D, had been willing to receive more loans than the so-called “the method of discount”, which submitted a sales contract with an excessive amount of money than the real purchase price, to the unit agricultural cooperatives.
2. Around April 5, 2010, the Defendant related to the victim Namsan Agricultural Cooperative submitted a false contract stating the purchase price of KRW 380 million in order to obtain a loan as security at the location of the new mine located in Suwon-gu, Busan-dong, Busan-dong, and the Busan-dong land (hereinafter “the instant land”). On the same day, the Defendant was assessed as KRW 380 million in the market price of the instant land at KRW 380,000 in Busan-dong and KRW 230,000 in the amount of KRW 20,000 in the amount of KRW 20,000,000 in the amount of KRW 30,000 in the amount of KRW 20,000 in the amount of KRW 12,000 in the amount of KRW 40,000 in the name of the debtor, and the Defendant was determined as the amount of KRW 400,000 in the name of the said association.
D On the other hand, upon the Defendant’s instruction, allowed C to sell and purchase the instant ambling land, and C was transferred to KRW 160 million out of the above KRW 240 million, and KRW 27 million, respectively.
Accordingly, in collusion with C and D, the Defendant acquired 240 million won from the South Busan Agricultural Cooperative, the victim, by fraud.
3. On August 2010, the Defendant related to the Victim Magapo Agricultural Cooperative, along with C and D, is the Plaintiff’s land of this case: (a) 3,058 square meters in Y-si; (b) 656 square meters in riJ-si; (c) 430 square meters in ri-si and ri-si; and (d) 97 square meters in ri-si and ri-ri land in this case.
