1.The judgment of the first instance shall be modified as follows:

The defendant shall set forth in the attached list from the plaintiff.

1. Facts of recognition;

A. On November 2013, the Plaintiff operating the trucking transport business entered into a consignment management contract with the Defendant, which provides that the Defendant may operate the trucking transport business using the Plaintiff’s registered name of the trucking transport business (excluding value-added tax) and the Defendant would pay the Plaintiff, who is a party to the instant automobile, the amount of penalty imposed on the Plaintiff and the fine for negligence in relation to the instant vehicle operation (hereinafter “instant consignment management contract”).

(2) According to the entrusted management contract of this case, where the defendant did not pay management expenses for more than three months, the plaintiff can unilaterally terminate the contract without the notice of performance.

B. The instant consignment management contract was renewed after setting the first term of the contract as one year. While the Defendant engaged in freight trucking services using the instant vehicle, the Defendant sent a document verifying the content of the instant consignment management contract to the Defendant on July 2, 2015, stating that “The Defendant paid KRW 5,024,660,00,000 to July 10, 2015, out of the total of KRW 12,702,00,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,00,000.

C. On August 20, 2015, the Plaintiff expressed his/her intent to terminate the instant consignment management contract on the grounds that the Defendant did not pay management fees, etc. in the instant complaint. The duplicate of the instant complaint was served on the Defendant on August 20, 2015.
