1. All of the plaintiff's claims are dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. On December 8, 2008, the Defendant entered into an insurance contract in attached Form 1 (hereinafter “instant insurance contract”) with the Plaintiff as the insured or beneficiary of insurance money out of death, and entered into an insurance contract with the content that the insured would receive hospital treatment due to injury, disease, etc. (hereinafter “instant insurance contract”).

B. From January 14, 2009 to February 10, 2009, the Defendant was hospitalized at Mapo-si Medical Center for 28 days, and was hospitalized at Mapo-si Medical Center until September 22, 2014 as shown in attached Table 2, and was hospitalized for 377 days in total, and received KRW 34,42,031 from the Plaintiff as insurance money under the instant insurance contract.

C. Meanwhile, before and after the conclusion of the instant insurance contract, the insurance contract concluded between the insurance company including the Plaintiff and the Defendant as the insured, and the insurance premiums and hospitalization allowances paid therefrom are as listed in the following table.
