1. The defendant shall be the plaintiff.

가. 피고는 2011. 11. 15. 원고로부터 서울 마포구 C빌딩 제지하층 제34호 점포 40.04㎡(별지 도면 표시 ㉮, ㉯, ㉰, ㉱, ㉲, ㉳, ㉴, ㉵, ㉮의 각 점을 차례로 연결한 선내 부분, 이하 ‘이 사건 점포’라 한다)를 보증금 700만원, 차임 88만원(부가세 포함), 기간 계약일로부터 12개월로 정하여 임차하면서, 차임을 2개월 이상 연체할 경우에는 임대인이 언제든지 계약을 해지할 수 있다고 약정하였다.

B. The above lease agreement was explicitly renewed every one year thereafter, and the Defendant did not pay a five-month difference from June 2014 to October 201 of the same year.

C. Accordingly, the Plaintiff filed the instant lawsuit on November 24, 2014, and the Defendant later paid the difference of three months on a intermittent basis.

2. On the ground that the Defendant did not pay the rent for five consecutive months, the above lease contract was lawfully terminated, since the Plaintiff expressed his/her intent to terminate the above lease contract by serving a duplicate of the complaint of this case.

Therefore, the Defendant is obligated to deliver to the Plaintiff the instant store, which is the leased object, and to return unjust enrichment equivalent to the rent calculated by the ratio of 880,000 won per month from June 1, 2015 to the completion date of the delivery, which is the following day after the final calculation: 920,000 won, which is the remainder after deducting the deposit from the total amount of the rent or unjust enrichment in arrears (i.e., 7., 7

3. The plaintiff's claim is justified, and the costs of the lawsuit are assessed against the defendant. It is so decided as per Disposition.
