Defendant shall be punished by a fine of KRW 1,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

No one shall gambling using the act of offering property or property benefits to persons who win the result by issuing (including issuing through an information and communications network) sports promotion voting rights or things similar thereto operated by the Korea Sports Promotion Foundation and a person who is not an entrusted business entity.

Nevertheless, from October 10, 2015 to June 20, 2016, the Defendant: (a) accessed the Defendant’s smartphone to the Internet in the Defendant’s residence in Gangnam-gu Seoul building 101; (b) connected the Defendant’s smartphone to the online private sports site (D); and (c) deposited KRW 24,010,000 in total from the Defendant’s post office account from C to the deposit account of the online sports site on 367 occasions, such as in the list of crimes, and deposited the corresponding game money in Korea after collecting the betting amount, and then receiving a certain percentage of dividends depending on whether it is reasonable.

The reason for sentencing under Article 334(1) of the Criminal Procedure Act is that the defendant does not have the same criminal records, and there is no criminal records exceeding the fine, the defendant reflects his/her mistake, the economic environment is not good, and the punishment is determined in consideration of the conditions of sentencing as shown in the records and arguments of this case.
