Reasons
Punishment of the crime
Even if the Defendant entered into the lease contract with another person as the lessee residing in the contract from around September 8, 201 to September 8, 2013, the Defendant did not have any intention or ability to lease the above 601 subparagraph, as it is difficult for the Defendant to pay monthly rent to the lessor of the above 601 because he did not have any other place of residence, and as it is difficult for the said lessor to pay monthly rent to the lessor of the above 601 because he did not receive the deposit from others, even if he did not have any other intent or ability to return the deposit.
Nevertheless, around February 10, 2012, a notice was posted on the Kafbook "F" bulletin board "F", which is located in NAV, stating that "I will open a guarantee room." The monthly rent of KRW 700,000 for deposit shall be decided through consultation."
1. Around February 17, 2012, the victim G, who reported and searched the above writing in the above E Apartment 7 Dong 601, 2012, made a false statement to the effect that he/she would lease the above No. 601 with monthly rent of KRW 350,000,000 and the period of 70,000,000 per year.
The Defendant received KRW 100,000 from the victim, namely, as down payment, as down payment, from the victim, and received KRW 250,000 as monthly rent from the Defendant’s corporate bank account on or around the 20th of the same month, and KRW 700,000 from the Defendant’s corporate bank account on or around the 25th of the same month.
2. Around February 18, 2012, the victim H, who reported and found the above writing in the above E Apartment 7 & 601, made a false statement to the effect that he/she would lease the above No. 601 for the monthly rent of KRW 350,000 per month, and for the period of KRW 700,000 per month.
The Defendant received 700,000 won from the victim as contract deposit in the corporate bank account of the Defendant on the same day.
3. Around March 1, 2012, the victim I, who reported and searched the above writing in the above E Apartment 7 601, 601, made a false statement to the effect that I would lease the above No. 601 with monthly rent of KRW 3.80,000,000 and the period of 1 year.
