피고인은 2014. 12. 14. 14:30 경 경북 의성군 C에 있는 피고인의 집 앞길에서 피해자 D에게 멱살을 잡히고 얼굴을 맞자 이에 대항하여 주먹으로 D의 얼굴을 수회 때려 D에게 약 14일 간의 치료를 요하는 머리 및 안면 부 으깸 손 상 등의 상해를 가하였다.
