Defendant
A Imprisonment for one year, and each of the defendants B shall be punished by imprisonment for ten months.
However, for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Defendant A
(a) A person who intends to engage in loan business or loan brokerage business for unregistered loan business shall register with the Special Metropolitan City Mayor, Metropolitan City Mayor, Metropolitan Autonomous City Mayor, Do Governor, or Special Self-Governing Province branch having jurisdiction over the relevant place of business;
Nevertheless, at the office located in Seodaemun-gu Seoul Metropolitan Government (Seoul) around August 16, 2016, the Defendant, without registering, loaned KRW 25 million to E who wish to contact with the number of days, and agreed to pay KRW 100,000 per 60,000 per day after deducting KRW 100,000 from the interest rate of KRW 20,000 per annum, and loaned KRW 334.4% per annum from July 20, 2015 to March 30, 2016, the Defendant re- loaned the loan business from the office located in the second floor of Yongsan-gu Seoul Metropolitan Government (hereinafter “Seoul Metropolitan Government”) 26 times as in the table 1 to 26 days of crime, from April 14, 2016 to March 21, 2017.

(b) Where an unregistered credit service provider grants a loan exceeding the interest rate, the interest rate shall not exceed 25 percent per annum;
The Defendant, as a unregistered credit service provider, at the office located in Seodaemun-gu Seoul Metropolitan Government D and 501 around August 16, 2016, loaned KRW 2.5 million to E who wish to contact with the applicant who reported the number of days advertising, and agreed to pay KRW 100,000 per 60 days each day after deducting KRW 10,000,000 from the interest rate for 20 days, and loaned at the interest rate of KRW 334.4% each year from July 20, 2015 to March 30, 2016, the Defendant loaned the loan at the interest rate of KRW 26 times from the office of Yongsan-gu Seoul Metropolitan Government 2nd floor to the 26th day of crime list 1 to 26th day of crime, from April 14, 2016 to March 21, 2015 to the 26th day of Seoul Special Metropolitan Council 20 through 25, 2017.
