Basic Facts

The related defendant of the parties is a clan comprised of descendants who jointly set up theO (hereinafter referred to as "defendant clan"), and the plaintiffs are the clan members of the defendant clan.

The reason for each resolution of this case was that N's funeral was lost, which is the first time of the defendant clan. From 1983 to 1983, there has been disputes as to whether the graves of this case were N's funeral or not and the method of confirmation among the members of the defendant clan.

On August 14, 2009, the defendant clan made a resolution of the board of directors of the case with the purport that the defendant clan will carry out the business of maintaining the overall burial ground, such as the construction of a tombstone (hereinafter referred to as the "maintenance project of this case") by regarding it as N's grave without the procedure of directly confirming the identity of the buried person, such as opening the tomb of this case by holding a board of directors at the Daejeon P hotel.

On March 25, 2011, the defendant clan held a general meeting in Qu located in Mapo-gu Seoul Metropolitan Government to approve the business performance, settlement of accounts, and audit report of the defendant clan in 2010, and later, it is called the "Promotion Committee" (hereinafter referred to as the "Promotion Committee").

The first general meeting of shareholders was adopted with the content that the entire rearrangement project of this case is to be delegated to the above promotion committee and to proceed.

On June 17, 201, the promotion committee held the first meeting on October 28, 201, the second meeting on October 28, 2011, the third meeting on March 7, 2012, and the fourth meeting on July 4, 2012, respectively, and resolved on specific matters, such as the grounds, procedures, budget, and duties of the improvement project in this case.

The defendant clan held a temporary board of directors on December 14, 2012 and reported the results of the maintenance project of this case comprehensively.

Defendant clan held an ordinary general meeting in Qu located in Mapo-gu Seoul on March 28, 2013 and received the comprehensive report on the instant improvement project, the activities of the promotion committee, the budget and settlement of accounts in 2012, the status of acquisition of surrounding land, etc., and the land ownership related to the instant improvement project is secured.
