1. 피고인들의 공동범행(공무집행방해) 피고인들은 부부 사이로, 2016. 6. 10. 22:25경 수원시 장안구 C에 있는 'D' 라이브 카페 앞길에서 폭행 사건이 발생하였다는 112신고를 받고 출동한 수원중부경찰서 E지구대 소속 경사 F와 같은 지구대 소속 경장 G이 피고인 A이 위험한 물건인 시멘트 벽돌을 휴대하고 H을 때릴 듯이 위협하는 모습을 목격하고 피고인 A을 현행범인으로 체포하려고 하자, 피고인 B는 위 F과 G이 피고인 A을 현행범인 체포하는 것을 막기 위해 위 G의 멱살을 잡고 뒤에서 위 G의 머리카락을 잡아당겨 위 G이 피고인 A에게 접근하지 못하도록 하고, 피고인 A은 현행범인 체포에 극렬히 저항하면서 위 F을 밀쳐 위 F으로 하여금 피고인 A과 함께 바닥에 넘어지게 하고, 피고인 A의 팔을 붙잡고 있는 위 F의 오른쪽 정강이 부분을 수회 발로 걷어찼다.

이어서 피고인 B는 위 G이 피고인 B를 뿌리친 후 다시 피고인 A의 다른 쪽 손목에도 수갑을 채우려고 하자 이번에는 극렬히 저항하는 피고인 A을 제압하고 있던 위 F에게 달려들어 위 F의 머리카락을 잡아당기고 손톱으로 얼굴 부위를 할퀴고, 피고인 A은 발로 위 G의 오른쪽 허벅지 부위를 1회 걷어찼다.
