A defendant shall be punished by imprisonment for a term of one year and eight months.

Punishment of the crime

1. On October 2015, the defrauded Co., Ltd., Ltd., E (hereinafter “E”) office operated by the Defendant on the level D and 1 as of the end of the end of the year, the Defendant stated that “A victim C, who is an employee of the said company, borrowed the amount of KRW 100 million due to the shortage of the company operating funds and the purchase price of goods, may cause damage if he/she borrowed money with the company’s loan, and used it only for six months and around March 2016, he/she would pay 750,000 won per month.”

However, at that time, the Defendant had no intention or ability to repay the borrowed amount as agreed upon even if it borrowed money from the victim of the damage, due to the failure to repay the debt to the lending companies, such as card companies, Samsung Card, New Card, Han Card, etc., and E, and the credit rating was lower than 10.

Defendant deceiving the victim as above and managed by the Defendant KRW 60 million around October 30, 30 of the same year from the victim, and KRW 30 million around November 13 of the same year from the victim.

E received a total of KRW 90,000,000 from transfer to an enterprise bank account (Account Number G), respectively.

Accordingly, the defendant was given property by deceiving the victim.

2. On August 16, 2016, the criminal defendant against the victim H made a false statement to the J Hospital located in Mapo-si, Mapo-si, Mapo-si, Mapo-si, Mapo-si, Mapo-si, stating that “The defendant had an opportunity to deliver large volume of goods to large enterprises, the cost of purchasing the goods is insufficient, and if the goods are purchased and supplied at a cost of KRW 2-300 million, the profit of KRW 100 million would accrue, and if the defendant lent KRW 66 million, including interest, until January 16, 2017, he/she would pay KRW 10 million, the principal of the deposit borrowed from K, as well as KRW 110 million.”
