A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On December 26, 2012, the Defendant was sentenced to one year and two months of imprisonment at the Gwangju District Court for fraud, etc., and completed the enforcement of the sentence on October 30, 2013. On November 11, 2015, the Gwangju District Court sentenced the Defendant to one year and six months of imprisonment for a violation of the Act on the Protection of Children and Juveniles against Sexual Abuse, and the said judgment became final and conclusive on April 1, 2016.

1. On August 18, 2015, the Defendant: (a) around 23:30 on August 18, 2015, the Defendant was engaged in as if the Defendant would pay the drinking value, etc. in the Esing room operated by the victim D (49 tax) located in Gwangju Seo-gu; (b) the Defendant demanded the victim to pay the drinking value, etc.; (c) the victim demanded 16 C, the market price of which is equivalent to KRW 80,000, the 16 C, the market price of which is equivalent to KRW 40,000, the 30,000, the 1, 1, and 2 hours of singing.

However, the defendant did not have any intention or ability to pay the alcohol or alcohol even if he was provided by the injured party.

The Defendant received an alcoholic beverage and analju equivalent to the market price of KRW 300,000 from the injured party, and acquired economic benefits equivalent to the same amount.

2. On August 19, 2015, the Defendant: (a) 01:30 on August 19, 2015, while under the influence of alcohol at the said Esing room, the Defendant saw the victim’s face as a drinking problem; (b) Hashed the victim’s face several times; (c) Hashed the victim several times, and (d) the victim’s diagnosis and injury around the alcohol that requires approximately two weeks’ treatment.

3. The Defendant violated the Resident Registration Act at around 02:30 on August 19, 2015, in the course of accompanying the instant Esing room with respect to the suspected injury as referred to in paragraph 2, thereby verifying the personal information of the slope group G belonging to the F District of the Seoul Western Police Station in the Gwangju Seo-gu, Gwangju, and attempted to conceal the fact that he/she is serving a fine as if he/she were H.

H's resident registration number was denied and used unlawfully.

4. Forging a private document;

A. On August 19, 2015, the Defendant was required to voluntarily accompany from the slope G belonging to the F District of the Police Station of Gwangju Seo-gu in the Esing room around 02:30 on August 19, 2015.
