A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The defendant is a person who has no fixed residence and occupation as a ship of Chinese nationality.
1. On May 23, 2019, at around 22:40, the Defendant: (a) did not possess a cash or settlement card at the main point of “D” operated by the victim C, an Ansan-si Member B; and (b) did not have an intent or ability to pay the alcohol value; (c) placed the victim as if he would pay the alcohol value; and (d) placed an order for alcohol and alcohol as if he would have paid the alcohol value to the victim; and (c) received two bottles, 1,000, and 1,000 from the victim.
2. At around 17:45 on May 27, 2019, the Defendant: (a) stated, “A victim E, who is a taxi driver, does not have cash or a settlement card, from the Seoul Special Metropolitan City Housing Long-gu, Ansan-si, the Defendant: (b) stated, “A 40,000 won, 12 going out from the 12th west-si,” and said, as if the Defendant would pay the fare, the Defendant would have the victim operate a taxi to the destination; (c) said, upon arrival at the destination, the Defendant would wait for the victim; and (d) said, “A Ga to the place at which the said restaurant was entered; and (d) said 45 minutes after boarding the taxi of the victim; and (d) said 8 minutes after boarding the taxi of the victim, the Defendant would have the victim operate the taxi again by having the victim operate the Y-dong, including the distance of the 8th east-gu, Yongsan-si; and (d) said, the Defendant would have the victim operate the 80-dong.
Accordingly, the defendant, by deceiving the victims, acquired approximately KRW 119,800 property and property benefits.
