A defendant shall be punished by imprisonment for not less than one year and six months.

1. 공무집행방해 피고인은 2016. 8. 28. 06:20경 부산 동래구 C빌딩 앞에서 교통사고가 났다는 112신고를 받고 출동한 부산동래경찰서 D지구대 소속 경찰관인 E이 사고경위를 묻자 “뭐 이새끼야, 이 씨발놈이 뭘, 죽여버린다”라고 하면서 손으로 위 E의 목과 얼굴을 2회 때려 경찰관인 위 E의 112신고 업무 처리에 관한 정당한 직무집행을 방해하였다.

2. 모욕 피고인은 위 제1항과 같은 날 부산 동래구 F에 있는 부산동래경찰서 D지구대에서 위 제1항과 같은 이유로 공무집행방해의 현행범인으로 체포되어 오자, 택시기사인 G 등이 있는 자리에서 위 E에게 “병신새끼, 좆같은 경찰 짭새 새끼, 너 나가서 한판 붙으면 이길 수 있겠나, 개새끼야, 우리 아버지가 검사다, 좆같은 개새끼야”라고 말하여 공연히 피해자를 모욕하였다.
