A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On June 13, 2016, the Defendant was sentenced to six months of imprisonment and two years of suspended execution for fraud in the Hongsung Branch of the Daejeon District Court, and the judgment became final and conclusive on the 21st of the same month.

From May 2013 to July 2013, the Defendant: (a) was a person in charge of the sale of an officetel Ctel, the Defendant used the structure of the sales contract to make the sales contract, and the buyer pays the down payment, and (b) used the structure that the Defendant received 7.5 million won for each number of occasions to conclude the sales contract for an officetel, and had the victims acquire the sales fee.

On July 1, 2013, the Defendant: (a) sent the victim D a false statement to the effect that “Ctel is promoting resale to use it as a dormitory by E, an affiliate of the Samsung Group; (b) if the Defendant concludes an officetel sales contract and pays the down payment, he/she may receive a refund of KRW 3.5 million, a monthly rent for 8 months, as well as a down payment, by selling it in E, if he/she concludes an officetel sales contract and pays the down payment, he/she may receive a refund of KRW 3.5 million, a monthly rent for 8 months for an officetel; and (c) as the total amount of 10 bonds for each person can be contracted, 10 bonds in the name of private village or F; and (d) paid 50% of the down payment by dividing it into 8 bonds under four names, and 2 million won per officetel bonds.”

However, there was no plan to promote the resale of the above officetels or to pay down payment and monthly rent to the victim, which could not return down payment, etc. to the victim or pay the profit.

Nevertheless, the defendant deceiving the victim and let the victim enter into a sales contract for 8 officetels, and against 8 officetels in the name of the victim and 10 officetels in the name of F.
