A fine of three million won shall be imposed on a defendant.

Where the above fine is not paid, one million won shall be converted into one day.

Punishment of the crime

The defendant is the actual operator of C, and C is a corporation established for the purpose of chartered bus business, etc.

The defendant has overall control over the business of the company, such as paying the national pension premiums, health insurance premiums, and employment insurance premiums, after deducting the national pension premiums, health insurance premiums and other premiums.

1. Occupational embezzlement;

A. On October 2012, the Defendant occupational embezzlement of national pension contributions at the C office located in Si/Gu, Si, Gu, U.S.A., deducted KRW 39,600 from the national pension contributions as employee contributions, and paid it as national pension contributions for the victim. In violation of his/her duties while he/she was in a violation of his/her duties, he/she voluntarily consumed at the above office for the purpose of company operation funds, etc. from October 2012 to June 2014, as shown in the annexed crime list 1, and embezzled 6,222,280 won in total under the name of national pension contributions of 16 employees, such as E, a worker, for the victims, as shown in the annexed crime list 1 from October 2012 to June 2014.

B. Around July 2012, the Defendant embezzled 5,526,410 won of the total amount of health insurance premiums of 25 workers, E, etc. from the above C office, after deducting 27,800 won as employee contributions from the health insurance premiums of the victim E, and then paid them as health insurance premiums for the victim, in violation of his/her duties during the course of occupational storage of the victim, and around that time, he/she arbitrarily consumed it for the purpose of the company’s operation funds, etc. from July 2012 to June 2014, as shown in attached Table 1 of the Crimes List from July 2012 to June 2014, the Defendant embezzled 5,526,410 won as employee E, for the victims.
