1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. E on November 8, 2006, the owner of each real estate listed in the separate sheet, as stated in the reason for the completion of the registration of the establishment of a collateral for each real estate listed in the separate sheet, is a golded mutual savings bank (hereinafter “goldized savings bank”).
(2) On May 7, 2007, E sold the above real estate to G and H on May 7, 2007, and completed the registration of transfer of each of the above real estate on May 9, 2007. The registration of transfer of each of the above real estate was completed on May 9, 2007.
G and H on June 3, 2009, each real estate listed in the separate sheet Nos. 1 through 4 (hereinafter “each real estate of this case”) was sold to Defendant B, and each real estate listed in the separate sheet Nos. 5 through 7 was sold to Defendant B, and Defendant B and I completed each registration of ownership transfer on each of the above real estate on July 3, 2009.
3) On July 29, 2009, B and I completed the registration of creation of a neighboring mortgage of the debtor B, the maximum debt amount of 56,000,000 won with respect to each real estate listed in the separate sheet to the Gold Savings Bank. (B) On September 2, 2011, Defendant B and the Plaintiff’s children J on each of the instant real estate entered into a sales contract with the following month: (a) on September 2, 201, Defendant B and the Plaintiff sold each of the instant real estate at KRW 150,000,000, and (b) on September 2, 2011, Defendant B entered into a sales contract with the Plaintiff’s children J and the buyer’s obligation with respect to each
8. J completed each registration of ownership transfer with respect to each of the above real estate on September 2, 201, with the sale and purchase as of September 2, 2011 as the grounds for registration.
2. On April 26, 2012, the Gold Savings Bank applied for a voluntary auction on each real estate listed in the separate sheet to K of the Incheon District Court, and the said court on April 27, 2012.
