A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for four years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is in a de facto marital relationship with D, the mother of the victim C (n, 10 years of age) from around 2007 to around 7 years, and live in the same house as the above victim, and the above D and the victim E (n, 40 years of age) are in a pro facto marital relationship.

1. On December 2010, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (Indecent Act by compulsion in relation to Relatives) and the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (Indecent Act by compulsion in relation to minors under the age of 13) around December 2010, the Defendant and a person related to de facto marriage, who are in F at the home of D, made food at the home of the person related to de facto marriage at the home of the Defendant at the time D, were married in D and the victim C (the age of 8) who is a blick of the Defendant’s wife’s care to force indecent act by compulsion of the victim, using the victim’s her care, and the victim’s her cares

Therefore, when the victim said, “I need not go off. I do not refuse to do so,” the Defendant “I am fine.” In order to suppress the victim’s resistance and continued to repeat the above acts.”

Accordingly, the defendant committed an indecent act by force against the victim under 13 years of age, who is a de facto relative.

2. On July 2012, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (a quasi-rape, etc. in relation to relatives) and the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (a quasi-rape, etc. in relation to minors under the age of 13) demanded D to engage in sexual intercourse at the place indicated in paragraph (1) at the beginning around July 2012, the Defendant: (a) had the victim C (the female, 10 years of age) who was locked by drinking the victim’s body while enjoying the female’s body; and (b) had a negative part of the victim by spreading the arms by taking advantage of the victim’s condition

Accordingly, the defendant committed an indecent act on the victim under the age of 13 who is a de facto relative by taking advantage of the state of mental disorder.

3. On August 18, 2012, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (Indecent Act by compulsion in relation to relatives), is de facto marriage at the G Center 406 around August 18, 2012.
