A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

On December 2, 2018, the Defendant reported that “The Victim C purchases book cutting machines” on D Kafs, and falsely contacted the victim to sell book cutting machines at KRW 30,000.”

Around August 22, 2018, the Defendant: (a) visited the Defendant’s home located in Silung-si, Silung-si, on the Internet site called “F”; (b) falsely read that “The Victim G purchases 3 Drat M3 DD HD” posted on the bulletin board, and “The Defendant will send 280,000 won to the Defendant for remittance.”

However, even if the defendant receives the price of the goods from the victim, he did not have the intention or ability to send the above golf loans.

As such, the Defendant, by deceiving the victim and receiving KRW 280,00 from the victim’s new bank account in the name of the Defendant on the same day, for the purchase price of KRW 280,00,00 from around that day to November 7, 2018, received a total of KRW 725,000 through six times as indicated in the annexed crime sight table (2).
