1. Defendant Mob Construction Co., Ltd.: (a) KRW 86,415,00 for the Plaintiff and its related expenses from June 1, 2013 to September 23, 2013.
Reasons
1. Basic facts
A. The Plaintiff’s claim for the construction price against Defendant Mob Construction Co., Ltd. (hereinafter “Defendant Company”) has a claim for the remainder of construction amounting to KRW 86,415,00 for the Seocho-gu Seoul District New Construction Corporation, the Seocho-si Kindergarten New Construction Corporation, and the Cheongcheon District New Construction Corporation. On May 31, 2013, the Defendant Company issued and delivered a notarized deed under a monetary loan agreement with the Plaintiff on KRW 86,415,00 for the said construction price as a law firm, a notary public on May 31, 2013, as the certificate No. 152 of 2013, the said construction price was KRW 86,415,00.
B. On November 30, 2012, the Defendant Company entered into a contract with Malaysia Co., Ltd. (A) with the Defendant Company for the construction of a new neighborhood living facility in Mapo-gu Seoul Metropolitan Government (hereinafter “new construction of a neighborhood living facility”) with the contract amount of KRW 1,749,00,000 and the construction period from December 10, 2012 to July 10, 2013 (hereinafter “instant contract for the construction of a new neighborhood living facility”).
B) As of June 17, 2013, the Defendant Company received KRW 971,00,000,000 in total from Malaysia, from June 17, 2013, as construction cost under the instant contract.
2) On March 7, 2013, Defendant Company entered into a contract with B (hereinafter “instant contract”) with the Defendant Company setting the contract amount of KRW 762,30,000 on the ground E kindergarten construction work on a lot outside the Seoul Special Metropolitan City, Seocheon-gu, Seoul Special Metropolitan City (hereinafter “AF”) at KRW 762,30,000.
B. On June 12, 2013, the date of commencement of the above new kindergarten construction work, and the Defendant Company, from B before the date of commencement of the construction work, KRW 10,000,000, as the down payment under the instant two contract.
