1. Of the judgment of the court of first instance, the part against the defendant regarding each real estate listed in the separate sheet Nos. 1, 2 and 4 shall be revoked, and that part shall be revoked
Reasons
1. Basic facts
A. In the land survey division prepared during the Japanese occupation period, the decedent J’s land condition and land division 1) the land survey division shall be 12,420 square meters for 4 f. 1 f. f. 1 f. f. f. f. 1 f. f. f. 4 f
hereinafter referred to as “the assessment land of this case”
Around October 15, 1917 (Seoul 7) the name of the administrative district was changed to J in Yangju-gun of Gyeonggi on October 15, 1938, and the name of the administrative district was changed to Gu-si I in the Republic of Korea on October 1, 1938.
2) The land of this case was divided into K forest land in Gyeonggi-gun (hereinafter “the mother land of this case”), etc.
B. On February 20, 1968, from the mother land of this case divided the land of this case, one group of 1 forest land in Yang-gun, Gyeonggi Yang-gun on February 20, 1968 (330 square meters) and one group of 3 forest land in M M land (90 square meters in square meters) were divided, and on November 8, 1968, 9 forest Nanland in Yang-gun, Yang-gun (270 square meters in square meters) was divided.
C. 1) The old real estate register for the mother land of this case is registered as follows. ① On the ground that “the preservation of the claim for the transfer of land by reversion of rights on September 12, 1958” received on December 27, 1968, the preservation registration of ownership was completed under the name of O on the ground of “the preservation of the claim for the transfer of ownership by reversion of rights” (2) the registration of ownership transfer was completed under the name of the defendant on the ground of “the reversion of the right on September 12, 1958,” which was received on December 27, 1968. ③ The registration of ownership transfer was completed under the name of P on the ground of “the purchase and sale on December 14, 1962,” which was received on December 28, 1968. Meanwhile, the registration of ownership transfer was completed under the name of the defendant on March 5, 197.
Land, which is divided from the mother land of this case, is converted into 1,091 square meters on June 1, 197, and the area is converted into 1,091 square meters on June 1, 197.
