Reasons
Punishment of the crime
1. On June 17, 2017, the Defendant: (a) around the Gambi National University Global Campus located in Chungcheongnam-dong, Chungcheongnam-si around Jun. 17, 2017, the Defendant was the victim C with “450 square meters at a small-scale reduction period; (b) one hour and 30 minutes at Seoul.
Along with this, a false statement was made to the effect that “When investing KRW 20 million, the land will be purchased and registered under the name of the party, and the remaining expenses will be borne by the party and the profits will be borne by all of the expenses.”
However, the defendant's personal debt amounting to approximately KRW 130 million, and the monthly rent of the office in arrears is about KRW 15 million, and there was no particular property or income, and there was no ability to conduct real estate business. The money received from the victim was considered to be used for personal purpose.
Around June 19, 2017, the Defendant received KRW 5 million from the damaged party to the Agricultural Cooperative Account (E) in the name of the Defendant’s child, and deposited KRW 5 million in the same account on or around the 22th of the same month, and received KRW 10 million from the same account on or around the 23th of the same month.
Accordingly, the defendant was given property by deceiving the victim.
2. On June 27, 2017, the Defendant made a false statement to the effect that, at around 27, 2017 on June 27, 2017, the Defendant sent a photograph of a real estate sale contract stating false details as if he/she purchased the land at KRW 25 million with a mobile phone used by the victim C, as if he/she purchased the land in KRW 90,000,000,000,000,000,000.
However, in fact, the defendant's personal obligation reaches approximately KRW 130 million, and monthly rent of the office in arrears is about KRW 15 million, and there is no particular property or income, and there is no ability to conduct real estate business. The money that the victim suffered from the damage.
