A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[criminal history] On August 6, 2009, the Defendant was issued a summary order of KRW 1.5 million for a crime of violating the Road Traffic Act (drinking driving) in the resident support by the Daegu District Court. On November 8, 2013, the Defendant was issued a summary order of KRW 2.5 million for the same crime in the same court.

[Criminal facts]

1. On December 12, 2016, the Defendant operated a motor bicycle under the influence of alcohol level of 0.118% at the center of around 200 meters from the bus platform in front of the bus platform in front of the Yancheon-gun, Jeoncheon-gun, Jeoncheon-gun, Jeoncheon-gun, Seoul, to around 66 days before the center of the same military, while under the influence of alcohol level of 0.18% without a motor device bicycle license.

2. The Defendant in violation of the Guarantee of Automobile Compensation Act is almost a holder of an engine device as set forth in paragraph (1).

No owner of any motor vehicle shall operate any motor vehicle on a road which is not covered by mandatory insurance.

Nevertheless, the Defendant operated the motor bicycle that was not covered by mandatory insurance as described in paragraph 1.

3. On January 26, 2017, the Defendant operated a motor bicycle under the influence of alcohol with 0.102% of alcohol concentration in blood without a motor device license from the 8km section of approximately 8km to the front of food, from around 14:20 to around 14:20 to around 14:30 to around 230, 201, both of which are left in the same military market.
