A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On July 21, 2010, the Defendant was sentenced to a suspended sentence of ten months for the crimes of violation of the Road Traffic Act at the Jeonju District Court on July 21, 201, and was sentenced to a suspended sentence of two years for the crimes of violation of the Road Traffic Act at the Jeonju District Court on September 20, 2007.

Around 19:02 on April 20, 2013, the Defendant driven a D detailed car in front of the Defendant’s house located in Kim Jong-si, with a blood alcohol concentration of 0.122% 0.12%.

The reasons for sentencing under Articles 53 and 55(1)3 of the Criminal Act (hereinafter the following sentencing grounds) are found to have been subject to criminal punishment on five occasions in total, and the defendant was found to have been subject to suspended sentence, and two of them had the record of being subject to suspended sentence and were detained accordingly.

Nevertheless, considering the fact that the defendant again repeated the crime of this case, the blood alcohol concentration high, and the fact that driving on an expressway while under the influence of alcohol is highly dangerous, it is necessary to punish the defendant accordingly.

However, in consideration of the circumstances favorable to the defendant, such as the fact that the defendant raises a young child and reflects the crime of this case, the punishment shall be determined as per the order.
