Punishment of the crime
[criminal records] Defendant A was sentenced to a suspended sentence of two years for embezzlement at the Incheon District Court Branch on June 12, 2015, and the sentence was finalized on the 20th of the same month on the 20th of the same month. Defendant B was sentenced to imprisonment of one year and six months for fraud at the Suwon Branch on December 8, 2017, and the judgment became final and conclusive on February 13, 2018.
[Criminal facts] Defendant A is the Plaintiff F’s position and Plaintiff G are directors in the name of H, Defendant B is the operator of H, and Defendant I is the bropsyer.
Defendants, G, and I concluded a contract for the lease of facilities (lease) with H as if H were to purchase machinery from F such as flasma and cutting machines and as if it were to purchase it from F, and as if it were to be a lessee, H had to use the said machinery as operating funds by receiving the payment of the said machinery from F when F was paid by the injured party.
1. Defendants B and G jointly committed a crime by the Defendants: (a) purchased machinery, such as flass, cut machines, etc. from H from F at the office of H, Inc., the victim J, the employees of H, the victim J, at early 2014, at H’s office.
In a false manner, H as a lessee, and entered into a contract for facility leasing (lease) with the said machinery as a leased object.

A around the 16th day of the same month, at the office of F Co., Ltd. located in MM building N, submits an order acceptance letter, tax invoice, and estimate forged in the name of F Co., Ltd. to L, and I submits to L Co., Ltd. an agreement for the repurchase of goods, a copy of the board of directors, a written agreement for inquiry of personal information (credit), and a written consent for collection and use of personal information (credit) to L Co., Ltd. at the office of F Co., Ltd. located in the name of F Co., Ltd. on the same day, and F Co., Ltd. supplies the said machinery to H.
