A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On January 21, 2015, the Defendant was sentenced to imprisonment with prison labor for six months at the Changwon District Court for fraud, and the said judgment became final and conclusive on January 29, 2015.

When the Defendant borrowed a name to obtain a loan from the Party C with knowledge of the general meeting, he was proposed to pay the price, passenger car, and monthly salary of 2.5 million won every month after one year, and consented to it, he purchased construction machinery in the name of the Defendant, and offered to receive the loan by sharing the role of joint and several sureties to receive the loan.

On October 15, 2012, the Defendant: (a) drafted an “Agreement on Down-to-To-To-To-To-To-To-To-door, Yeongdeungpo-gu, Seoul; (b) purchased G construction machinery from F in 100 million won through the employees E of Camp Korea Co., Ltd., the victim E, a partner store of Iju Capital; (c) borrowed 78 million won out of the purchase price; and (d) paid the interest and principal of 19.9% per annum in installments for 48 months for each week; and (d) submitted it to conclude a contract with the victimized company.

However, the facts are that the defendant provided only the name to obtain a loan upon C's request, and the construction machinery was not purchased, and there was no intention or ability to pay the principal and interest every month due to the lack of occupation at the time.

The Defendant, in collusion with C and D, by deceiving the victim as above, received KRW 77,955,00 from the account of Camp Korea Co., Ltd. on the same day.
