The judgment of the court below is reversed.
A defendant shall be punished by imprisonment for four years.
The seized philopon 2.269kg (Evidence No. 1), test.
Reasons
1. Summary of grounds for appeal;
A. As such, there was no intention on the import of written phone.
B. The sentence imposed by the lower court (seven years of imprisonment) is too unreasonable.
2. Determination
A. 1) The summary of the judgment of the court below also asserted the same purport as the grounds for appeal in this part of the judgment of the court below, and the court below, in full view of the circumstances in its judgment, determined that the defendant at least recognized the possibility of being a narcotic drug and accepted it. Thus, the court below determined that the defendant could sufficiently recognize the defendant's willful negligence as to the importation of phiphonephones. 2) In full view of the above circumstances recognized by the evidence duly adopted and investigated by the court below, and the following circumstances recognized by the evidence, the court below's judgment is sufficiently acceptable, and there is no error of mistake of facts as alleged by the defendant.
Therefore, this part of the defendant's assertion is rejected.
