1. Occupational Death Co., Ltd. is a deputy head who is a person in charge of safety management of swimming pool workers, organization, safety education, etc. while working as a person in charge of safety management of swimming pool workers, Defendant B is a person who served in the above swimming pool as a person in charge of safety of water. Defendant A served as a person in charge of safety of water in the above swimming pool since May 30, 2017.

C In order to enable the swimming pool users to use a swimming pool safely and to thoroughly look at the occurrence of safety accidents, at least two water safety workers are placed in a swimming pool, and the education, supervision, and management of swimming pool workers are thoroughly conducted. Defendant B, as the water safety personnel of the swimming pool, has a duty of care to prevent the occurrence of safety accidents in the swimming pool or to provide prompt first aid after safety accidents. Defendant B, as a water safety personnel of the swimming pool, has a duty of care to prevent the occurrence of safety accidents in the swimming pool or to provide prompt first aid after safety accidents.

Nevertheless, Defendant C did not conduct safety education at all for the employees of the above swimming pool, including Defendant A, during the Defendant’s working period, and did not allow two persons qualified as water safety personnel to work at the swimming pool monitoring station around September 1, 2017, and Defendant A, a part-time employee without a water safety personnel qualification certificate, went back to the swimming pool’s infant pool and the pen pool. Defendant B did not work at the monitoring station even if he was a person holding a water safety personnel license.
