1. The judgment of the court of first instance is modified as follows.
Of the instant lawsuits, the part of the litigation cost of KRW 235,900 is claimed.
Reasons
1. Basic facts
A. On February 23, 2016, the Plaintiff entered into a lease agreement with the Defendant to lease a store Nos. 121 and 123 of the building C (hereinafter referred to as “121 store”) of the Gu Government-si building Nos. 121 and a store of 123 of the said building (hereinafter referred to as “123 store”) with the term of lease from April 1, 2016 to March 31, 2018, the lease deposit amount of KRW 20,000,000, monthly rent of KRW 1,100,000 (excluding value-added tax).

However, on October 25, 2016, the Plaintiff agreed to terminate the instant lease agreement with the Defendant as a broker D (E).

2. The details to be restored to the original state by the lessee shall be as follows:
- The costs of removing partitions installed in the store No. 123 shall be borne by the lessee.
- Water services facilities of the stores of heading 121 and 123 shall be restored to their original state.
- fish containers at the stores of 123 will be restored to their original state after the lessee is removed.
- The lessee shall remove the interior of the tin guide type in the wall of the store No. 123
3. The lessee shall pay to the lessor (the defendant; hereinafter the same shall apply) the rent of KRW 700,000 per month until the lease date of the store (based on the remainder date of the new lessee).
4. E (D) will not be borne by the lessor of the brokerage fee for commercial lease in the store No. 121, while the lessor of the store No. 123 will not be charged with the case of request for the article in E.
5. Upon completion of the eviction on October 28, 2016, the lessor shall transfer KRW 10,000 to the Plaintiff KRW 121,00,000,000.
(Provided, That the lessor shall settle the lease deposit to the lessee at the time of completion of the contract at 123 stores (based on the date of the contract). 6. The lessor shall settle the lease deposit at the time of completion of the contract (based on the date of the contract).
