When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

Persons who are eligible to carry out an election campaign by sending text messages by means of automatic broadcast communications at a time other than the election day shall be limited to candidates and preliminary candidates.

F선거구 구의원 예비후보 C입니다. 구의원 경선규칙이 국민여론 조사 100%로 발표되었습니다. 여론조사는 5월 10~12일 실시됩니다. 집, 사무실로 전화가 옵니다. C를 꾹 누릅니다. 열심히 일하는 C가 되겠습니다. 구의원 예비후보 C 지지자 A 드림(D)”이라는 내용의 문자메시지를 자동 동보통신의 방법으로 발송하였다.

The crime of this case with the reason for sentencing under Articles 70(1) and 69(2) of the Criminal Act is that the person who can transmit text messages by means of automatic broadcast communication utilizing mobile phones is a candidate even though he was employed by the candidate, and the person who received text messages is a majority of 320 persons who were sent such text messages.
