A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

In order to commit a telecommunications fraud crime, a person who is a general responsibility of the telecommunications-based financial fraud (hereinafter referred to as "scam") consists of various stages of measures, such as solicitation books, management books, inducements, cash collection books, etc. In order to facilitate the transfer of the amount of damage caused by scam, an employee in charge of solicitation books shall recruit cash collection books, withdrawal books, etc. to unspecified persons in Korea through B, etc., and connect them to the management books. An employee in charge of the management books shall instruct the scaming operator to commit a specific crime, and an employee in charge of the management books shall act as a functional management by ordering the scaming operator to commit a specific crime, and the staff in the inducement books shall act as a member of the Financial Services Commission, by misrepresenting the victims by telephone to the investigative agency, etc., and sending the victims’ account to the Financial Supervisory Commission, who is a cash collection book, under the name of the victims or an employee under his/her name of the Financial Services Commission.

1. Forgery of an official document;

A. On May 19, 2020, the Defendant: (a) around May 19, 2020, sent a total of 10 copies of a public text file under the name of the Chairperson of the Financial Services Commission, which was sent by e-mail from a single name “C,” a management responsibility for the scaming system; (b) around May 19, 202, the Defendant printed out a total of 10 copies of a public text file under the name of the Chairperson of the Financial Services Commission.
