A defendant shall be punished by imprisonment for a term of one year and two months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury resulting from Dangerous Driving) is a person engaged in driving a motor vehicle B.

At around 10:00 on May 25, 2020, the Defendant driven the said car while under influence of alcohol without blood alcohol concentration, and driven the five-lane road in front of the “D” located in Seo-gu Incheon Metropolitan City, Seo-gu, Incheon, at a speed of about 50 to 60km at the speed of about 50 to 60km from the offline of the E burial.

At the time, the Defendant had a duty of care to immediately stop driving to a person who is engaged in driving of a motor vehicle, as the Defendant was under the influence of alcohol and was unable to drive a motor vehicle normally due to the difficulty of driving the steering gear and brake system, such as significantly falling into the ability to properly operate the steering gear.

Ultimately, the Defendant driven the said car in a situation where normal driving is difficult due to influence of drinking, and suffered injury such as salt ties and tensions in the shoulder for about three weeks to the victim F, and suffered injury to the victim H(E and 7 years of age) who was accompanied by approximately four weeks of treatment.

2. On May 25, 2020, the Defendant violated the Road Traffic Act (e.g., refusal of measurement) was arrested as a flagrant offender after the occurrence of a traffic accident in the J District District located in Seo-gu Incheon, Seo-gu, Incheon at around 10:05, and the Defendant’s speech from K, etc., who belongs to the said J District.
