A defendant shall be punished by imprisonment with prison labor for four months.

However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

As a building business operator, the defendant is requested to construct facilities related to animals and plants on land C at the Namyang City, and the defendant is requested to construct facilities related to animals and plants on land D at the Namyang City adjacent to the above land.

1. The facts constituting C related to Namyang-si;

(a) No act of constructing a building, altering the purpose of use, installing a structure, changing the form and quality of land, cutting bamboo and trees, dividing land, piling up articles, etc. within a zone subject to special measures for the designation and management of a zone subject to development restriction, or any other act of piling up articles;

Provided, That where constructing buildings or installing structures prescribed by Presidential Decree and changing the form and quality of land is conducted for the residential, living convenience and livelihood of residents of a development-restricted zone, permission from the head of a Si/Gun/Gu shall be obtained.

On April 25, 2017, the Defendant cut the amount equivalent to 5.5m without permission from the competent authorities, unlike the previous permission obtained in Yangyang-si, which is a development restriction zone, and then cut it without permission from the competent authorities.33m in length, 90.33m in height, retaining wall of 0.0-3.5m in height, and retaining wall of 17.06m in height, and 2.5-4.0m in height, and installed structures.

(b) A person who intends to revise any permitted matter in violation of the Building Act shall obtain permission from the competent permitting authority, as prescribed by Presidential Decree;

The Defendant, without obtaining permission from the competent authority, constructed a retaining wall that is not included in a building permit, as described in the above paragraph A.

2. Crimes related to D related to Namyang-si.

(a) No act of constructing a building, altering the purpose of use, installing a structure, changing the form and quality of land, cutting bamboo and trees, dividing land, piling up articles, etc. within a zone subject to special measures for the designation and management of a zone subject to development restriction, or any other act of piling up articles;

Provided, That construction of buildings or construction of structures prescribed by Presidential Decree, which are facilities for the residence, convenience of living and livelihood of residents of development-restricted zones.
