A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

1. On April 16, 2014, around 12:00, the Defendant told the victim E to “D Mari-Ba,” which read, “I will make a full payment at any time when I wish to lend money to the victim E necessary to pay the money, and at the latest make a full payment by July 30, 2014.”

However, since around February 2014, the Defendant began to rapidly aggravated financial standing due to the following: (a) there was no income transfer from around March 2014; and (b) there was an obligation of KRW 100 million or more from the victim at the time of borrowing money from the victim; and (c) there was no intention or ability to repay the money even if he/she borrowed money from the victim.

The defendant deceivings the victim as above and transferred KRW 9 million to the Agricultural Cooperative Account (G) in the name of F, the defendant's child, from the victim.

2. The Defendant called the victim at around 15:00 on May 29, 2014, and sent the victim a telephone, and the Defendant is expected to complete the payment on September 2014, 2014.

The term "to pay the full-time and full-time loans" was called as "to pay the full-time and full-time loans."

However, since around February 2014, the Defendant began to rapidly aggravated financial standing due to the following issues: (a) there was no income transfer from around March 2014; and (b) there was a debt of KRW 100 million or more from the victim at the time of borrowing money from the victim; and (c) there was no intention or ability to repay the money even if he/she borrowed money from the victim.

The defendant deceivings the victim as above and transferred 2.64 million won to the Agricultural Cooperative Account (G) in the name of F, the defendant's child, from the victim.
