1. Facts of recognition;

A. Defendant Red Profit Construction (hereinafter “Defendant Red Profit Construction”) is the executor of the new construction project in Ulsan-gu, Nam-gu, Seoul (hereinafter “instant apartment”) and Defendant Central Construction Co., Ltd. (hereinafter “Defendant Central Construction”) is the executor of the instant apartment.

The Plaintiff (Appointed Party) and each of the designated parties listed in the separate sheet of 1 (including the appointed parties; hereinafter referred to as the “Plaintiffs”) are buyers who purchased from the Defendants each of the 48 square, 50 square, and 57 square units among the instant apartment units.

B. From among the plaintiffs who entered into the instant sales contract between the plaintiffs and Defendant Hongk Construction, 50 persons including the designated parties E, enter into each of the instant sales contract with Defendant Hongk Construction at the price discounted by 15% from the initial sale price (hereinafter "the first discount sale contract of this case") (hereinafter "the first discount sale contract of this case"), and each of the households that purchased the instant apartment after completing the registration of ownership transfer according to the sales contract is currently residing in each of the households.

In addition, on May 201, the remaining designated parties, excluding the above 50 buyers, among the plaintiffs, sold the apartment of this case at a discount of 20% from the initial sale price (hereinafter "second discount sale"), Defendant Red Profit Construction and the sales contract of this case (hereinafter "the second discount sale contract of this case"), and each of the above sales contracts of this case (hereinafter "the second discount sale contract of this case"), and each of the above first discount sale contracts of this case is incorporated into the first discount sale contract of this case, and the sales contract of this case is registered for transfer of ownership in accordance with the sales contract of this case and currently reside in each household that sold the apartment of this case.

C. (1) The Defendants concluded a sales contract with the buyers of the instant apartment at the time of the instant 1 and 2 discount sales contract, and they concluded a sales contract with the buyer, and as to each of the instant apartment units after the passage to the buyer.
