피고인은 2016. 5. 24. 00:15경 부산 동래구 B에 있는 C모텔 앞 노상에서 일행인 D과 같이 팬티만 입은 채로 서로 말다툼을 하며 시비하다가 위와 같은 이유로 112신고를 받고 출동한 피해자 경찰공무원 E이 음주소란 등으로 통고처분을 하자, 피해자에게 “씨발 내가 50이 넘었는데 새파란 새끼가 달려드노, 계급장 떼고 한번 붙자, 나를 총으로 쏴 죽이던지 잡아가서 쳐 넣던지 씨발새끼들아 마음대로 해라, 얄팍한 공권력 믿고 경찰관이라고 스티커 끊으면 다가, 좆같은 새끼야.”라고 불특정 행인들이 지켜보는 장소에서 큰소리로 말하여 공연히 피해자를 모욕하였다.
