A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On August 5, 2013, the Defendant was issued an order to summary a fine of KRW 1.5 million by a fine of KRW 1.5 million at the site of Suwon District Court as a crime of violating the Road Traffic Act (driving) at the site of Pyeongtaek District Court, and on September 5, 2014 by the same court as the same crime, respectively.
Although the Defendant had had a alcohol driving twice as above, on May 14, 2015, the Defendant driven a CS5 car under the influence of alcohol with approximately 13 kilometers in the section of about 0.06% of the blood alcohol concentration from the road near the restaurant of the “marb farm site” located in the Gyeyang-si in Ansan-si to the road located in the 395-ro, Y-si, Yan-si.
Accordingly, the Defendant, even though he was a person driving at least twice, was driving a motor vehicle under the influence of alcohol again.
2.
