1. The Defendant shall pay to the Plaintiff KRW 26,775,840 as well as 20% per annum from July 22, 2014 to the day of complete payment.
Reasons
1. Facts of recognition;
A. The defendant is a juristic person with the purpose of manufacturing and installing landscaping facilities and materials, and the non-party C was working as the head of the business division in the area of Gangwonwon from November 15, 201 to November 22, 201. The non-party D is a person in charge of performing duties as the vice head of the defendant's business division from the time of withdrawal to the time of withdrawal.
B. On the beginning of 2011, the Plaintiff proposed that C be engaged in the business of mediating the sale of products, such as materials produced by the Defendant, and C reported this to E, the representative director of the Defendant.
C. Accordingly, around May 201, the Plaintiff, C, and E agreed at the Defendant’s representative director’s office to recognize the Plaintiff’s business rights for the Defendant’s product via a three-party meeting, and C and E paid 10% of the sales amount to the Plaintiff via internal meetings.
In accordance with the above agreement, the Plaintiff identified the construction site for the supply of the Defendant’s product for the business of the Defendant’s product, and sent C a report on the commencement of the business, stating the name of the construction, the place of the order, and the outline of the construction work, and received evaluation as to whether to approve the business, and C determined whether to approve the business by examining whether the Defendant itself overlaps with the sales customer.
The Plaintiff started the business of the business partners or construction sites approved by C through the above process, and arranged the Defendant to deliver the products produced by the Defendant while discussing the business direction by exchanging e-mail with Defendant’s employees, including C.
On the other hand, after C has retired, the Plaintiff sent the above form report to D and obtained business approval.
E. The Plaintiff arranged to the Defendant for the “F School Forest Development Project” for the purchase of materials, etc., and the sales commission equivalent to 10% of the sales commission is KRW 3,834,600 on December 23, 201, and KRW 220,00 on July 24, 2012.
