A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

Punishment of the crime

On February 5, 2020, the Defendant was sentenced to one year of imprisonment with prison labor for habitual larceny, etc. at the Jeonju District Court on April 1, 2020, and the said judgment became final and conclusive.

On May 23, 2019, the Defendant: (a) around 03:00, at the convenience store operated by the victim C in Busan-gun, Busan-gun; (b) did not intend or have the ability to pay the purchase price of the goods; (c) ordered the victim “1mg ice ice 10 grams; (d) on the same day, the Defendant presented the Defendant’s KB credit card, which was stolen, to the Defendant, and paid the purchase price; and (c) received the above tobacco worth KRW 45,000 in total at the market price from the victim.

Accordingly, the defendant used stolen credit cards and acquired the property of the victim.

2. On May 23, 2019, the Defendant: (a) around 03:07, at the H convenience store operated by the injured party G in Busan Metropolitan Government F, the Defendant did not have the intent or ability to pay the purchase price, even if he purchased the goods; (b) the Defendant ordered 10 cigarette 10: (c) on the same day, issued an order for 10:0 tobacco; (d) on the same day, the Defendant presented the said KB credit card of E that was stolen by the Defendant as the Defendant; and (e) received the said tobacco from the injured party in total amount of KRW 90,000 at the market price.

Accordingly, the defendant used stolen credit cards and acquired the property of the victim.
