The defendant's appeal is dismissed.
Reasons
1. Summary of grounds for appeal;
A. In relation to the attached list of crimes committed by the court below, the court below found the defendant guilty of this part of the facts charged without any corroborating evidence other than the confession of the defendant. The court below erred by misapprehending the legal principles, although there is no supporting evidence other than the confession of the defendant.
B. The lower court’s sentence of unreasonable sentencing (one year and six months of imprisonment) is too unreasonable.
2. Determination
A. Reinforcement evidence of confessions made as to the assertion of misapprehension of legal principles is sufficient to the extent that it can be recognized that the confession of the defendant is not processed, even if the whole or essential part of the facts constituting an offense is not sufficient.
Indirect or circumstantial evidence, which is not direct evidence, can also be corroborative evidence, and if facts constituting a crime can be acknowledged as a whole as evidence of guilt because confession and corroborative evidence mutually are recorded, it is sufficient to establish evidence of guilt.
(2) In light of the above legal principles, the victims’ statements and photographs of each place of crime are consistent with the Defendant’s statements and photographs, taking full account of the following circumstances acknowledged by the lower court’s duly admitted and investigated evidence. In other words, the Defendant made a confession to this part of the facts charged first, in a situation where there is no other proviso to investigation at the investigative agency, and the Defendant made a very detailed statement about the date and time, place, amount of damage, the current situation at the time of the crime, and the course of intrusion, etc., and there is no inconsistency between the above statements or there is no other evidence contrary to the above statements. As such, each of the victims’ statements and photographs of each of the places of crime in this part of the facts charged are consistent with the Defendant’s statements and photographs.
Therefore, the defendant's assertion of legal principles is without merit.
B. The trial-oriented principle and the principle of directness on the assertion of unfair sentencing are applied.
