1. The defendant shall be the plaintiff.
(a) deliver the buildings listed in the separate sheet;
B. From October 1, 2016, 3,899,800 won and above.
Reasons
갑 1∽6호증의 각 기재에 변론 전체의 취지를 종합하면, 원고가 2008. 5. 23. 피고에게 이 사건 건물을 임대차보증금 500만 원, 월차임 44만 원(부가가치세 포함)으로 정하여 임대하고, 피고는 이 사건 건물을 인도받아 점유하고 있는 사실, 피고가 원고의 동의 없이 무단 증축함으로써 건축법위반에 따른 이행강제금 2,339,800원이 원고에게 부과되었으나 그 중 20만 원을 대신 납부하였을 뿐이고, 2016. 9. 30.까지 월차임 4개월분 176만 원을 연체한 사실, 임대차계약해지 의사 표시를 담은 이 사건 소장이 피고에게 송달된 사실이 인정된다.

The Plaintiff asserted that the Defendant did not pay the management expenses of KRW 4,927,133 as of September 30, 2016, and that the Plaintiff sought payment of the management expenses of KRW 4,927,133 and the future management expenses of KRW 4,50,000 from October 1, 2016, but the Plaintiff paid the management expenses on behalf of the Plaintiff.
The plaintiff's claim for this part is dismissed as there is no proof of the fact that the management expenses of the building of this case are KRW 450,000 per month.
The plaintiff's claim shall be partly accepted within the extent of the above recognition.
