1. The part against the defendant in the judgment of the court of first instance shall be revoked, and the plaintiff's claim corresponding to the revoked part shall be dismissed.
Reasons
1. Facts of recognition;
A. On September 7, 1971, the Plaintiff’s share acquisition and sale 1) C, D, and E are F in Gyeonggi-do on September 7, 1971 (hereinafter “F”).
B) On November 20, 1990, the registration of ownership transfer was completed with respect to D’s 1/3 shares of 84,397 square meters of G 84,397 square meters of G 84,397 square meters of forest land. On August 14, 1973, E’s 1/3 shares were subject to donation under the name of O on August 14, 197, and the registration of ownership transfer was completed on June 21, 2004 under the name of P 98, 84,397 square meters of forest land was completed on June 11, 2004; 295, 397 square meters of forest land was divided on June 11, 2004 into G 82, 95 square meters of forest land; 104 square meters of H 104, 104 square meters of forest land; 39/395 square meters of forest and forest shares after division into G 979/195 square meters of forest and forest shares.
3) On November 17, 2005, G forest 82,959 square meters after the division, G forest 5,306 square meters and Q forest 27,653 square meters (hereinafter “ Q forest”) are the grounds for partition of co-owned property on November 17, 2005.
As a result, with respect to shares in Q forest, 9,90/82,959 shares in the Plaintiff’s name, with respect to shares in the name of the J as to shares in Q forest, 27,654/82,959 shares in the name of the J, 17,754/82,959 shares in the name of K, with respect to shares in the name of L, 9,900/82,959 shares in the name of M, with respect to shares in the name of 17,751/82,959 shares, and with respect to shares in Q forest, with respect to shares in the name of M, 9,900/82,959 shares. On the other hand, with respect to shares in 41,479/82,959 shares in G 5,306 square meters after the division, each share transfer registration was completed in the name of P, and in the name of Q, with respect to the forest and forest after division.
