1. Defendant shall be punished by a fine of 5,000,000 won;

2. If the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

On June 4, 2014, the Defendant worked as a volunteer from April 30, 2014 to F registered as a candidate through a preliminary candidate for the E market of D Political Parties with respect to the 6th nationwide local election (hereinafter “instant election”), which was implemented on June 4, 2014.

The Defendant, in the instant election, arbitrarily via Internet telephone (H) with the aim of getting F to win the E market with the intention of getting F to win the E market, without obtaining the F’s consent or holding consultations, (1) from around 19:06 to around 19:43 on May 3, 2014, at the above election preparation office, the Defendant informed preliminary candidates to select the E market candidates of the method of competition in the pertinent election campaign office, as well as (2) prior to “1 degree of E market suitability,” from among all candidates,” with the contents of the preliminary candidates to select the E market candidates of the D party from around 19:06 to around 19:4,00, and (3) from around 13:5, 2014 to around 14:5, the Defendant again prepared a text message at the name of the E citizen, i.e., “I wish to receive a copy of the E market,” and sent it again to the E market from around 7:15, 2014.

(hereinafter) The above text messages are “each of the instant text messages.” As a result, the Defendant expressed two times a name contrary to each truth in order for F to be elected from the instant election to the E market, and made communications by means of telephone and other telecommunication.
