1. The Defendant (Counterclaim Plaintiff) pays KRW 30,500,000 to the Plaintiff (Counterclaim Defendant).

1. Basic facts

A. On July 9, 2013, the Defendant, as the owner of land C, concluded a construction contract with the Plaintiff with respect to the remaining construction work during the construction of a multi-family house (hereinafter “instant house” and “instant construction work”) on the ground as the owner of the land at the time of strike, with the following content (hereinafter “instant construction contract”).

◎ 착공일 : 2013. 7. 8. ◎ 준공예정일 : 2013. 8. 30. ◎ 계약금액 : 5,000만 원 (계약시 1,450만 원, 건축물 매도계약시 3,550만 원) ◎ 건축물의 공개공지 부족시 준공을 위해 상호 협력하도록 하고 건축주가 인근 토지를 매입하거나 건축물에 절단 등의 조치를 취하여 준공할 수 있도록 한다

(단, 건축주는 건축물 완공으로부터 20일 이내 결정하여야 하며, 결정이 없을 경우 건축물을 절단하며 절단비용은 건축주가 부담한다. 또는 60일 이내 3,550만 원을 지급한다. 지연이자는 2할로 한다). ◎ 건축물 준공 후 가능한 빨리 매도하며, 건축주와 상호 의논하고 매도가액은 3억 5,000만 원 이상 매도해야 한다.
