1. The plaintiff's appeal is dismissed.

2. The costs of appeal shall be borne by the Plaintiff.

The purport of the claim and appeal is the purport of the appeal.

1. Basic facts

A. 1) The Plaintiff is the mother of C who has lived in Spanish study from August 1, 2015 to July 31, 2016. 2) The Defendant deals with various duties on behalf of the students of Spanish under the trade name of Dpanish learning institutes.

B. On April 8, 2015, the Plaintiff and the Defendant entered into a contract with C to provide C with various services, such as providing Spanish schools and private teaching institutes, on behalf of the Defendant, from August 1, 2015 to July 31, 2016. The Plaintiff entered into a contract with the Plaintiff that, on behalf of his parents, the Plaintiff will pay for all necessary services to ensure the stable livelihood of his children when his children live in a dormitory or home park.

(hereinafter “instant contract”). The main contents of the instant contract are as follows.

Article 1 (Obligation of Defendant) (1) The Defendant shall perform his/her duty of care as a good manager so that C may enter a scheduled school to be admitted, in providing and processing the following duties for C:

1. Counseling (Provision of information on hydro-high speed courses, school information, lodging, airplanes, insurance, local life, etc.);

2. Introduction and entrance agency of Spain schools and private teaching institutes;

3. Preparation of applications for admission to schools in Spain and private teaching institutes;

4. Sending and responding to application documents;

5. Vicarious execution of documents to issue visa in Korea;

6. Selection of DNA services and accommodation by proxy;

7. Spanish local airport traffic (on arrival and departure from Korea);

8. Purchase of insurance and vicarious sales of airline tickets;

9. Article 2 (Obligation of the Plaintiff) ① The Plaintiff’s obligation to pay the expenses for studying abroad (such as school expenses, night consumption, Dr., etc.) agreed upon when concluding a contract to enable the Defendant to carry out his/her agency business for studying abroad, and the expenses to be borne, such as the purchase of insurance, non-self-employed expenses, flight equipment expenses, and insurance premium, etc., on the fixed date.
