A defendant shall be punished by imprisonment for six years.

Punishment of the crime

On December 4, 2012, the Defendant had no property at the time, and had no obligation exceeding KRW 100 million, while making investments in stocks, etc., and had to continuously appropriate profits from the victim C to pay other persons’ profits, etc., and even if having received money from the victim C under the pretext of investment, the Defendant did not have the intent or ability to properly pay the profits while guaranteeing the principal. However, even if the Defendant did not have the intent or ability to pay the profits, the Defendant would guarantee the principal when having the money to make a stock investment and pay the profits of 1% per month to the victim C.

“Along with the purport of the foregoing, the victim’s false statement, including the receipt of KRW 5 million from the victim C to the Agricultural Cooperative Account (D) under the name of the Defendant for the same day as an investment deposit, is to receive KRW 5 million, by means of the same method as the statement in the attached Table 1 “crime Method” column from the victim C during a total of 19 times from December 4, 2012 to July 31, 2017, the victim was to receive KRW 95 million in total from the victim C to the above account, and to receive KRW 15 million in total from the victim E in the same manner as the statement in the attached Table 2 “Crimes Method of Crimes” column, and to receive KRW 160 million in total from the victim E to September 29, 2017, and to receive KRW 150 million in total from each of the above accounts with the victim’s intent to receive KRW 500,000,000,000 from each of the above corporations.

“Falsely speaking to the purport that it is a victim, the victim was transferred KRW 80 million from the victim F to the said account as an investment deposit, and the victim was in the same manner as indicated in the column for “Method of Crimes” in the attached Table 3 of the List of Crimes.
