1. The Defendant’s KRW 11,751,160 for the Plaintiff and the Plaintiff’s annual rate from February 18, 2017 to May 15, 2018.
Reasons
1. On February 18, 2017, the Defendant: (a) was liable to compensate the Plaintiff for injury by taking the Plaintiff’s horse as knife microphones; (b) taking the Plaintiff’s face and body from several times; (c) taking the Plaintiff’s face and body back to several times, demanding approximately three weeks of treatment; and (d) taking the Defendant’s punishment of special injury on November 23, 2017, including imprisonment with prison labor for ten months, suspension of execution of two years, etc. (Seoul District Court Branch Branch Branch Branch Branch Branch Branch Branch Branch Branch Branch Branch Branch Branch Branch Branch Branch Branch Office 2017Ma2130), and the fact that the judgment became final is recognized by adding to the entire arguments as indicated in subparagraphs A through 6 (including serial number; hereinafter the same shall apply).
According to the above facts, the defendant is obligated to compensate the plaintiff for the damages suffered by the plaintiff due to the assault of this case.
2. Scope of liability for damages
A. The Plaintiff, at the time of the occurrence of the instant accident, was paid approximately 4.5 million won per month in Lcare and worked as a DNA, but if he retired on February 18, 2017 due to the instant assault, he/she was unable to normally work due to the instant assault, and accordingly, asserted that the Plaintiff’s damage was KRW 18 million as a result, but the evidence submitted by the Plaintiff alone is insufficient to recognize the said damage. Therefore, the Plaintiff’s assertion on this is without merit.
B. According to the evidence No. 7, the Plaintiff is acknowledged to have spent the total of KRW 1,751,160 as indicated in the following table from February 18, 2017 to April 10, 2017 due to the instant assault.
