A defendant shall be punished by imprisonment for a term of one year and four months.
Reasons
Punishment of the crime
1. From early 2009, the Defendant: (a) from around 708, the victim D’s mother, living together with E and was de facto in a de facto marital relationship; and (b) falsely stated that the victim operates a lending company “F” with the victim as if he/she was in a de facto marital relationship; and (c) he/she would lend it to other persons for more than three copies per month if he/she made an investment.
However, since the defendant did not engage in credit business, even if he did not receive investment money from the victim, he did not intend to use it as his daily living expenses, etc. and did not have an intention or ability to lend it to others to allow them to enjoy more than three copies of profit per month.
As above, the defendant deceivings the victim, and is also against the victim.
3. From around 18.18. to the Agricultural Cooperative (G) account under the name of the Defendant, the sum of KRW 170,414,770,00 from that time to April 11, 201, including the transfer of KRW 9 million, was remitted to the Defendant’s account in the name of the Defendant or to another person’s account designated by the Defendant.
2. Around July 2009, the Defendant made a false statement to the victim H that he/she was aware of through D that he/she would lend money to others when he/she received money from others and would allow them to receive interest on the three-month basis.
However, as stated in Paragraph 1, the defendant did not have an intention or ability to lend it to another person to allow him/her to profit from more than three copies per month even if he/she received investment money from the victim.
The defendant deceivings the victim as above and is subject to the same year as investment money from the victim.
9. A total of KRW 10 million around 18.1,00,000,000 around 19.19,000 around the same month, and KRW 30,000,000 around 25.1,000 around the same month, shall be transferred to the Agricultural Cooperative Account in the name of the Defendant I.m.
