1. The Defendant: (a) KRW 36,629,906 for the Plaintiff and the Plaintiff’s KRW 5% per annum from December 25, 2015 to May 16, 2019; and (b) May 2019.
Reasons
1. The description of the grounds for the claim shall be as specified in the attached Form;
2. Article 208 (3) 1 and Article 257 of the Civil Procedure Act.
3. Pursuant to the provisions on statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases concerning Expedition, etc. of Legal Proceedings on Partial Dismissals, the part of the Plaintiff’s claim for payment of damages for delay exceeding the rate of 12% per annum from June 1, 2019 is dismissed.
However, the defendant shall bear all the costs of lawsuit by applying the proviso of Article 101 of the Civil Procedure Act.
