A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On September 26, 2006, the Defendant received a summary order of KRW 700,000,000 as a fine for a violation of the Road Traffic Act, and on July 30, 2018, the same court received a summary order of KRW 6 million as a fine for the same crime.

On October 17, 2019, at around 08:08, the Defendant driven a DNA car with a blood alcohol concentration of about 500 meters from the front of the member-gu, Ansan-si to the front of the same Gu C, without obtaining a driver's license, while under the influence of alcohol of about 0.061%.

In this respect, the Defendant violated Article 44(1) of the Road Traffic Act more than twice and operated at the same time as a license without permission.

1. Taking into account all circumstances, such as the defendant's erroneous determination of sentencing under Article 62-2 of the Social Service Order Criminal Act, the criminal records of the defendant, blood alcohol concentration level, driving distance, etc.
